Response to FEC Counsel Brief
According to Robert Joseph, who claims to have participated, there was a scheme to destroy John’s election and have Sean Reyes appointed to replace him. The assault continued after John Swallow took office in January, 2013 and intended to cause a vacancy and install Reyes as Attorney General. After Swallow resigned, other potential candidates for the office were targeted, including former Lt. Governor Greg Bell and former Senate President John Valentine, so as to leave Reyes standing as the presumptive candidate for appointment.
From paragraph 47 in the affidavit: “The ultimate objective was to force the resignation or impeachment of Swallow, so Sean Reyes, could be appointed to fill the Republican vacancy. There were many others on the Reyes team working on that objective.”
The John Swallow Takedown
Article by Lynn Packer, former investigative reporter and BYU Journalism professor outlines the story and corroborates that John Swallow was indeed the victim of a calculated political assault by Sean Reyes and his campaign manager, Alan Crooks.
It describes but does not identify a GOP State Central Committee member who reportedly said, in reference to Alan Crooks, Reyes campaign manger: “Crooks was giddy when he learned before the public announcement that Reyes was the governor’s pick. He took credit for the Swallow takedown,”
Gunderson Complaint & Response
According to a statement submitted in an official Utah State Bar investigation, a high ranking cabinet member asked a subordinate to prepare a “Bar Complaint” personally to give the government “plausible deniability.”
The complaint, later dismissed, was signed almost a year in advance of the filing, but held and filed at the tipping point of the House discussion to investigate. The cabinet member was an open campaigner for Reyes and had motive to remove Swallow due to his campaign pledge to restructure the Division of Consumer Protection.
Admission by Traci Gundersen submitted in an official Utah State Bar investigation on September 27, 2013. In Section V she admits to being asked to secretly prepare a bar complaint in her own name. It states: “I was asked by Department of Commerce Executive Director Francine Giani … to draft a bar complaint in my individual capacity as an attorney of the bar because … it allowed the client ‘plausible deniability.’” Giani was not only a member of the Herbert cabinet, she was Gundersen’s direct supervisor.
They got it right: John Swallow Acquitted
According to Davis County Attorney Troy Rawlings, the House Investigation into Swallow was influenced by a former senior Department of Justice executive, Steve Reich, who left the DOJ on July 24, 2013, a little over a week after the House published a RFP for the Swallow investigation.
In a radio interview from October, 2019, Rawlings discussed a $2 million bribe of Senator Harry Reid admission and DOJ interference to cover it up. He suggests that the investigation by the Utah House of Representatives and its findings were compromised. Rawlings stated that what happened to John Swallow is “analogous” to what happened to Donald Trump in Washington.
John Swallow became the scape goat for a $3 million expense by the investigation team. In the interview, Mr. Rawlings states that “the jury got it right in the John Swallow trial” and that “the case should never have gone to trial” (John Swallow should not have been charged).
